HARI CATERING & EVENT GMBH –HARI AUM GMBH AGB

  1. General Information

    HARI CATERING & EVENT GMBH (hereinafter referred to as “HARI CATERING & EVENT GMBH”) with its business address at Newaldgasse 5, 1090 Vienna, operates a restaurant, a delivery kitchen, and an online shop on the website: www.harisbistro.com for the sale and delivery/pick-up of food and beverages. In addition, HARI CATERING & EVENT GMBH offers catering and party services.

    The content and services on www.harisbistro.com are self-explanatory, available in real-time, and subject to continuous changes. HARI CATERING & EVENT GMBH reserves the right at any time to change and/or discontinue the offerings on www.harisbistro.com, in the restaurant, in the delivery kitchen, catering, events, and other web portals such as Lieferando, Foodora, Mjam, Wolt, DasEssen, TheFork, Quandoo, TripAdvisor, Google, Connex, Open Table, and other portals, in whole or in part, without providing reasons, either for all users or for specific groups of users, either temporarily or permanently.

    Scope of Application

    1. For the business relationships between the online shop operated by Hari Catering & Event GmbH (hereinafter referred to as “Hari Catering & Event GmbH”) at www.harisbistro.com and the restaurant on one side, and the customer (hereinafter referred to as “customer”) on the other side, only the following terms and conditions (hereinafter referred to as “T&Cs”) in the version valid at the time of the respective order apply.

Deviating terms and conditions of the customer are not valid unless HARI CATERING & EVENT GMBH has expressly agreed to them in writing or by email before accepting the order. The terms of use apply to the use of the website. The terms of use apply upon the user’s consent during registration or when placing an order, covering all current and future orders from the customer.

  1. Deviating agreements from the T&Cs require written form to be effective.

    By placing orders (in the restaurant, online, or by phone), the customer explicitly acknowledges the T&Cs. All agreements, especially oral agreements with representatives of HARI CATERING & EVENT GMBH and telephone orders, require written confirmation.

Conclusion of Contract

The language of the contract is German.
The prices and offers listed by HARI CATERING & EVENT GMBH on the website “www.harisbistro.com” in the online shop are non-binding and subject to change. The webshop may be deactivated at any time.

By placing an order in the restaurant or online, the customer legally acquires the food/goods and/or services. By placing the order, the customer explicitly acknowledges these T&Cs. Once the order is received by HARI CATERING & EVENT GMBH, the customer will receive an email with an order confirmation for the items they ordered at the email address they provided. This order confirmation serves as acceptance of the order, and the contract between the customer and HARI CATERING & EVENT GMBH is concluded. In the restaurant, the contract is concluded between the customer and HARI CATERING & EVENT GMBH once the customer enters the restaurant and orders food or drinks.

Subject of the Contract

The subject of the contract is the goods ordered by the customer and listed in the order confirmation, at the prices indicated on the order date in the online shop or restaurant, plus delivery charges. No delivery charges apply for certain districts if the order exceeds a minimum amount, e.g., 30.00 euros.

  1. HARI CATERING & EVENT GMBH explicitly points out that the photos on the website are sample images, and the actual appearance of the goods may differ from these photos. Any size and weight specifications of the products are approximate values and subject to natural product variations.

Ordering

Orders can be placed from Monday to Saturday between 11:00 AM and 9:00 PM, with order processing occurring exclusively during business hours. No orders will be processed or delivered on Sundays. For events where Hari Catering & Event GmbH provides catering and/or service staff, an individual written agreement is required.

Orders must be placed by 9:00 PM on the same day of delivery or pick-up. For special catering and party services, delivery times must be individually agreed upon with HARI CATERING & EVENT GMBH.

Pick-Up

Pick-up is only possible by prior arrangement during the respective branch’s opening hours.
The pick-up will take place at the branch specified during the order, at the requested pick-up time by the customer.
HARI CATERING & EVENT GMBH will have the ordered goods ready for the customer at the specified pick-up time, for a duration of 30 minutes from the requested pick-up time, at the branch indicated during the order. If the pick-up is not made within 30 minutes from the requested pick-up time, HARI CATERING & EVENT GMBH is not obliged to keep the ordered goods available.

III. Delivery

Unless otherwise agreed, the delivery will be made to the provided billing address. If no exact delivery address is provided, the billing address will be considered the valid delivery address. The customer is responsible for all costs arising from incorrect, incomplete, or unclear information.
Deliveries are made only from Monday to Saturday. No deliveries are made on Sundays, except for specially arranged catering and party services. Deliveries may also be carried out by third-party companies.

  1. The customer can place orders during the following times:
    Monday – Saturday from 11:00 AM to 9:00 PM
  2. Sunday – Rest day

A delivery is only possible within the Vienna city limits and in certain Vienna districts. The delivery areas will be announced by Hari Catering & Event GmbH on the website www.harisbistro.com and may be changed at any time.
For each delivery, a delivery fee of EUR 9.90 (nine euros and ninety cents) may be charged, depending on the delivery district and minimum order amount. If the minimum order amount of EUR 30.00 is reached, there will be no delivery fee in certain districts.
Tip: A voluntary amount paid by the customer, intended for the delivery person.

Opening Hours:

  • Monday – Friday: 10:30 AM – 10:30 PM
  • Saturday: 12:00 PM – 10:30 PM
  • Sunday: Rest day

During lockdown, opening hours may vary. Opening hours are subject to seasonality and may change at any time.

Prices and Payment Terms

All prices are stated in EURO and include the applicable statutory VAT (10% or 20%).

For orders placed in the Hari Catering & Event GmbH online shop, payment is required before delivery in the online shop. For pickup, customers can choose to pay in cash or by card on-site, but they also have the option to pay for their ordered items online in advance.
For orders and payments made in the online shop (www.harisbistro.com), delivery or pickup is only possible after payment via credit card (Visa, MasterCard, EPS, and PayPal). For home delivery, the customer also has the option to pay by debit card, credit card, or cash.

Promotions & Coupons:

  • 20% or 10% Discount Vouchers: Only valid in the restaurant (not for delivery or takeaway). Not valid for Mjam, Foodora, Lieferando, Wolt, DasEssen, The Fork, Quandoo, Sodexo, Edenred, Connex, Gourmet 24, other portals, or lunch menus!

  • 10% and 5% Online Discount: Available by entering a coupon code starting with KK** on the website www.harisbistro.com. This offer is only valid for online purchases and cannot be redeemed in the restaurant. Not valid for Mjam, Foodora, Lieferando, Wolt, The Fork, Quandoo, Open Table, Sodexo, Edenred, Connex, or lunch menus.

  • 10% Voucher: Valid only in the restaurant, no cash redemption possible.

  • Self-pickup offer: Customers can receive 1 free 0.25l drink with a minimum order value of EUR 30.00. This offer does not apply to lunch menus or daily specials.

  • Only one coupon per order can be redeemed. Combining coupons with promotional vouchers or other coupons is not permitted.
  • Coupons have no market value, are non-transferable, and cannot be sold.
  • Coupons or promotional vouchers must be presented to the waiter or at the register before placing the order for the discount to be applied.
  • Subsequent redemption of coupons for already placed or ongoing orders is excluded.
  • Coupons and promotions do not apply to lunch menus, other daily offers, or special promotions.
  • When reserving by phone or in writing, customers must inform Hari Catering & Event GmbH of the coupon in advance (e.g., via email).
  • Coupons and promotional vouchers are not valid for lunch menus, company parties, events, or similar activities.
  • Validity is as per the flyer or advertisement, and the date is indicated on the coupon.
  • This promotion can be revoked at any time.
  • Coupons and promotional vouchers are not valid for lunch menus, special promotions (e.g., The Fork, TripAdvisor, Quandoo, Mjam, Foodora, Wolt, Lieferando, DasEssen, Connex, Gourmet 24, Moments of Taste, restaurant vouchers, and other portals).
  • Not valid for room rental, event spaces, catering, events, or similar services.
  • The terms and conditions of Hari Catering & Event GmbH apply as outlined on the website.
  1. Retention of Title

    Until the full payment of the purchase price, including all additional fees, the delivered goods/food/drinks/services remain the sole and unrestricted property of HARI CATERING & EVENT GMBH.

    Liability/Warranty

    The liability of HARI CATERING & EVENT GMBH is limited to damages caused intentionally or by gross negligence. Any mandatory statutory liability provisions remain unaffected.

    All products are inspected by HARI CATERING & EVENT GMBH before delivery or provision in the store/kitchen. The instructions for the shelf life and storage of the goods must be strictly observed. It is recommended to consume hot food immediately after delivery or serving. If the goods/food/drinks purchased from HARI CATERING & EVENT GMBH are not properly stored or consumed later, HARI CATERING & EVENT GMBH disclaims any warranty and liability.

    Defects that cannot be immediately detected despite careful inspection (during packaging or serving) must be reported immediately upon discovery. Otherwise, they are considered approved.

    HARI CATERING & EVENT GMBH strives to resolve any disturbances as quickly as technically and economically possible. However, HARI CATERING & EVENT GMBH does not warrant that the website www.harisbistro.com is always accessible without interruption and that the desired connection can always be established. If necessary for business operations or to prevent disruptions in use, HARI CATERING & EVENT GMBH is entitled to temporarily suspend services, including interrupting or limiting data connections. Therefore, uninterrupted operation of www.harisbistro.com is not guaranteed. It is also stated that the contractual performance of services depends on external third parties such as mobile network providers or internet providers, who are not agents or subcontractors of HARI CATERING & EVENT GMBH. HARI CATERING & EVENT GMBH assumes no liability for damages caused by such third parties, nor for damages arising from network failures or other circumstances outside of HARI CATERING & EVENT GMBH’s control (e.g., IT disturbances, power outages, force majeure, etc.). Therefore, warranty claims, compensation claims, and all other claims by the customer against HARI CATERING & EVENT GMBH are excluded.

    Exclusion of Warranty and Other Liability

    HARI CATERING & EVENT GMBH assumes no warranty or liability in connection with the contractual relationship between the customer and any third party or company. Warranty claims, compensation claims, and any other potential claims by customers against HARI CATERING & EVENT GMBH are completely excluded, especially regarding the timeliness of services, the quality, functionality, and scope of goods, food, or services, the correctness or redemption of promotions, discounts, prizes, etc.

    Cancellation of Order

    Given the perishable nature of the offer, the customer is not permitted to cancel the contract. Orders cannot be canceled by the customer. A cancellation of the order to HARI CATERING & EVENT GMBH is only possible if HARI CATERING & EVENT GMBH explicitly indicates that a cancellation is allowed.

    HARI CATERING & EVENT GMBH reserves the right to cancel the order, e.g., if the offer is no longer available, if the customer provides incorrect or non-functional contact details, or in case of force majeure. HARI CATERING & EVENT GMBH is also entitled to reject all (future) orders from the customer if there are valid reasons.

    If the customer places an incorrect order (e.g., by providing incorrect contact information, not paying, or not being present at the delivery or pickup location), HARI CATERING & EVENT GMBH is entitled to reject future orders from that customer.

    HARI CATERING & EVENT GMBH reserves the right to reject orders and terminate contracts if there are reasonable doubts about the correctness or authenticity of the order or contact details, or if HARI CATERING & EVENT GMBH does not wish to enter into a contract with the customer. If the customer places an order that is clearly false or fraudulent, HARI CATERING & EVENT GMBH is entitled to report it to the police. If the customer places orders that appear false or fraudulent, HARI CATERING & EVENT GMBH can report this to the police.

    Right of Withdrawal (For Party Rooms, Catering, and Room Rentals)

    Not applicable for daily deliveries:
    To exercise the right of withdrawal, the customer must inform HARI CATERING & EVENT GMBH in a clear statement, within at least 14 (fourteen) days (e.g., by letter sent by post or email), about their decision to withdraw from the contract.

    To comply with the withdrawal period, it is sufficient for the customer to send the notification of withdrawal before the expiration of the withdrawal period.

    In the case of withdrawal, the following withdrawal form must be completed and returned to HARI CATERING & EVENT GMBH (Attachment I):
